Delivery Information

Fast, free, and dependable delivery & pick up within a 20-mile radius of the 77008 zip code.

For residential rentals, we deliver the machines the morning of your event and pick them up the next day. Delivery times will depend on the logistics of the route that day. Deliveries begin at 8 AM and are usually completed by noon. Heights Margaritas will let you know your delivery window the week of your event.

A same-day pick-up fee for rented spaces will be applied for event hall rentals. For the safety of our staff, we will not pick up past 8:00 PM for orders that require same-day service. The machines need up to 2 hours to freeze please make sure we have access to the building or tent space to set up the machine well in advance.

Please note the machines are cumbersome and can not be delivered upstairs or more than 1-2 steps, including the landing. If you have 1-2 steps leading to your front or back door please let us know so we can plan accordingly. The machines are delivered on a cart. The cart cannot roll through gravel, rocks, or grass. If you want the machine in your backyard, there must be a smooth path leading to the backyard, or we can bring it in through the house. Cancellation must be made 24 hours in advance to receive a refund. Credit card fees will be deducted from your refund.

All machines require a 115-voltage plug (a normal household plug). If you need an extension cord, we can provide one. The extension cords must be 12 gauge commercial cords. Your standard household extension cord will NOT work on the machine.

How Many Machines do you need?

Layout

All orders include 50 cups and 50 straws. If you require additional supplies, please let us know by providing specific details such as "We need 2 extra margarita mixes and 1 extra set of cups". In an attempt to minimize plastic waste, kindly inform us if you have your own cups and straws.

Please let us know where you would like the machine to be set up - indoors or outdoors? We want to remind you that the machines are quite heavy, so they cannot be moved upstairs or more than two steps up. Additionally, the cart that the machine comes on cannot be rolled through grass, gravel, or over rough terrain. Therefore, it would be best if you could plan for a clear and smooth path for your delivery. If these conditions are not available, we will set up the machine in the best place we can find. If there is a gate code required to access your address, please let us know. Please note that we reserve the right to refuse service to any location that does not meet the safety requirements listed above for delivery or is unable to secure the machines in a safe and secure location. *

Terms and Conditions of Rental Contract

Terms of Lease:

In addition to the terms below, and the operation guidelines on each rented item, the Lessee (CUSTOMER) agrees to supervise the operation of any rented item and further agrees that if the item is damaged that CUSTOMER will reimburse HEIGHTS MARGARITAS for the full price to fix the damage and /or the full replacement value of the rented item. Before signing this contract, Lessee agrees that CUSTOMER has read the entire contract, has agreed to all terms and conditions herein, and has had all questions the customer may have answered to Lessee & Lessor full satisfaction and understanding.

Delivery/Operation/Payments:

To address specified by Lessee. Lessee grants HEIGHTS MARGARITAS and its employees/contractors the right to enter said property for the delivery and return of the rented equipment at approximated times. All payments must be made prior to delivery. No refunds will be made after the equipment has been delivered. Lessee agrees to provide on electrical outlet rated at 115 volts with 20 amperes capacity per machine. No CUSTOMER extension cords are to be used. Lessee agrees to only use the extension cords supplied by HEIGHTS MARGARITAS. The electrical cord should be plugged into an outlet and be the only thing operating on the electrical circuit. Circuit breakers should also be checked. Customer is subject to an additional charge of $40.00 for all service calls due to electrical concerns. Service calls will be conducted after all deliveries are completed for that day.

General Rules for Safe Operation:

Units must be operated over a smooth, compatible surface such as a wooden or cement deck or hard top surface. The unit may NOT be operated on rough surfaces such as rocks, soft dirt or grass. Unit cannot be moved by Lessee after placed by HEIGHTS MARGARITAS employees/contractors, Machine MUST NOT be removed during period of rental. NEVER attempt to relocate, adjust or service a machine. NEVER use during high winds, gust winds, thunderstorms or lightening. The unit can turn over in high winds, even if anchored, and this could result in severe injuries to the users. DO NOT resume use until adverse weather condition have ceased.

Additional Safety Rules:

Always have an adult present who has reviewed and understands both this contract and the rules posted on the unit itself and who can supervise other users. The safety of this unit and those around this unit is the CUSTOMER responsibility. Never allow other users to be unsupervised around the unit. Never allow young users to use the machine without supervision. DO NOT allow horseplay around the unit. Always follow the directions for use of the units itself.

HEIGHTS MARGARITAS does not condone underage drinking and rental of the machine is made with the belief that Lessee will follow the law in regards to alcohol consumption. By signing this contract, you attest that you will follow the law regarding drinking by minors and driving while intoxicated. Additionally, by signing this contract, you completely indemnify HEIGHTS MARGARITAS from any and all actual or assumed responsibility for any repercussions, legal or otherwise, that occur as a result of alcohol consumption for our rental machine or mixed with our beverages mixes.

Additional Terms of Lease:

HEIGHTS MARGARITAS is not responsible for bad weather, disruption of electrical service and/or unfavorable condition that may arise and no changes or fees will be reimbursed as a result.

ABSOLUTELY NO other mix other than the mix HEIGHTS MARGARITAS PROVIDES are allowed to be used with the machine rental. Other mixes will have different levels of sugar content which can cause the mix to freeze solid at different temperatures than our mix and will cause permanent damage to the unit. Lessee will be responsible for the full replacement value of the rented unit and /or required to pay for full repairs and missed income during the repairs if the unit is deterred not to be permanently damaged. Lessee agrees not to operate the unit(s) in a manner contrary to the contract and rules of use on each unit. If the unit(s) is/are damaged, Lessee agrees to pay the cost or repair of full replacement value of any damaged equipment or unit. Lessee agrees that the equipment leased is for Lessee own use and said equipment is not be loaned, sub-let, mortgaged or in any other manner disposed of by Lessee. Lessee further agrees to be liable for any loss of said equipment by reason of fire, theft or any other cause.

HOLD HARMLESS PROVISIONS:

Lessee agrees to indemnify and hold HEIGHTS MARGARITAS harmless from any and all claim, actions, suits, proceedings, cost, expenses, fees, damages and liabilities, including but not limited to reasonable attorney fee and cost, arising by reason of injury, damage, or death to person or property, in connection with or resulting from the use of leased equipment. This includes, but is not limited to, the manufacture, selection, delivery, possession, use, operation, or return of the equipment. Lessee herby releases and holds harmless HEIGHTS MARGARITAS from injuries or damages incurred as a result of using, moving or transporting the leased equipment. HEIGHTS MARGARITAS cannot, under any circumstances, be held liable for injuries to the lessee or any guest of the lessee as a result of carrying or moving the machine up steps, stairs, gravel or uneven pathways, through yards, grass, stone or any other natural pathway, force majeure or other conditions. Lessee also agrees to indemnify and hold harmless HEIGHTS MARGARITAS from any loss, damage, theft or destruction of the equipment during the term of the lease and any extension thereof.

Breach/Indemnity/Arbitration:

In the event that Lessee breaches any of the terms of this lease, Lessee will pay for all consequential damages and further indemnify HEIGHTS MARGARITAS for all cost incurred by HEIGHTS MARGARITAS in enforcing the terms of the lease or in defending any claim or lawsuit arising out of the operations of said equipment, including the amount of any judgement, attorney fees and cost. If HEIGHTS MARGARITAS determines, within its own discretion, that the Lessee has failed, in any way to observe or comply with the condition of the lease, HEIGHTS MARGARITAS may exercise any of the following remedies: termination of this agreement; re-enter property and retake the equipment; declare any outstanding rent and charges immediately due and payable and initiate whatever legal proceeding necessary to recover said equipment or monies; and/or purse any additional remedies available by law. If a conflict arises, HEIGHTS MARGARITAS and Lessee will abide by the HEIGHTS MARGARITAS state laws and forgo filing a lawsuit to solve the dispute.

BY SIGNING MY NAME ON THIS CONTRACT, I BEING THE LESSEE, CONTACT PERSON, LESSE REPRESENTATIVE OR THE INDIVIDUAL ASSUMING THE ROLE OF LESSEE, ACKNOWLEDGE THAT I HAVE COMPLETELY READ AND UNDERSTAND THE CONTRACT AND ANY AND ALL ACCOMPANIED ADDENDUM(S). I HAVE BEEN FULLY INSTRUCTED BY HEIGHTS MARGARITAS PERSONNEL AS A TRAINED OPERATOR FOR THE AFOREMENTIONED EQUIPMENT AND HAVE HAD ALL OF MY QUESTIONS ANSWERED TO MY SATISFACTION. I UNDERSTAND THAT I AM SOLEY RESPONSIBLE FOR ADHERING TO THE TERMS SET FORTH BY THE RENTAL CONTRACT AGREEMENT AND ANY AND ALL ACCOMPANIED ADDENDUM(S).
